Here's what happens when you do that: insurance dispatches their preferred tow company to their preferred repair shop. Those shops operate within insurance-negotiated rates, which can mean aftermarket parts instead of original manufacturer ones, and a repair timeline that suits the insurer's process — not yours.

Your Legal Rights in Ontario After an Accident

Under Ontario law and insurance regulations, you have the right to:

  • Choose your own tow company — no one on scene can force you to use a specific tower
  • Choose your own repair shop — your insurer can suggest a preferred facility, but cannot legally require you to use it
  • Choose your own rental car vendor — you're not obligated to use whoever insurance recommends
  • This applies even if the accident wasn't your fault. These rights exist regardless of your insurer, your policy type, or what anyone on scene tells you.

    What Happens When Insurance Dispatches Everything

    When your insurance company handles all the arrangements:

    1. Their preferred tow company picks up your car

    2. Your car goes to their preferred collision centre

    3. That shop works within insurance-negotiated pricing — sometimes using non-OEM parts

    4. Their preferred rental company gets you a car, usually 24–48 hours later after pre-authorization

    None of this is illegal. But it's worth knowing you have options.

    Step-by-Step: What To Do Right After a Collision

    Step 1: Check for Injuries

    Before anything else — check yourself and passengers. If anyone is hurt, call 911 immediately. Do not move injured people unless there is immediate danger.

    Step 4: Decline Uninvited Tow Trucks

    Tow trucks that show up uninvited are often monitoring police scanners. You are not required to use them. Say clearly: "I've already called my tow company." They cannot legally touch your vehicle without your consent.

    Step 5: Document the Scene

  • Photo every vehicle, damage angle, and road position
  • Exchange licence, registration, and insurance with the other driver
  • Note cross-street or highway kilometre marker
  • Get witness contact info if available

    Step 7: Notify Your Insurance
