Ontario has some of the most consumer-friendly towing regulations in North America, thanks to Bill 258 — the Towing and Storage Safety and Enforcement Act (TSSEA). Here's what this means for you.

Your Right to Choose Your Tow Truck

Under Ontario law, no tow truck driver can move your vehicle without your consent. Even at an accident scene, you have the right to:

  • Choose which company tows your vehicle
  • Choose where the vehicle is taken
  • Not sign anything under duress
  • If a tow truck driver pressures you or starts hooking your vehicle before you agree, this is illegal. You can refuse and call the company of your choice.

    Regulated Towing Rates

    Under the TSSEA, towing and storage companies in Ontario must:

  • Provide a written estimate before towing
  • Charge regulated rates (set by the province)
  • Not charge more than the quoted amount without consent
  • Accept multiple forms of payment including credit and debit
  • Storage Fee Caps

    Before Bill 258, some unethical companies would accumulate massive storage fees before you could retrieve your vehicle. Now, storage fees are capped, and towing companies must give you reasonable access to retrieve your belongings within 24 hours.

    Watch out for these red flags:

  • Tow trucks that arrive before police at an accident scene (they monitor scanners)
  • Drivers who refuse to tell you where they're taking your car
  • Demands for cash-only payment
  • Pressure to sign documents quickly
  • Threats that your car will be left behind if you don't agree immediately
